The criminal attorney that you hire or is assigned to you should be very knowledgeable about criminal law. This individual should not only have been to law school and completed the bar examination, but also have practice in criminal courts regularly, that way the lawyer would have learnt the ups and downs of the criminal defense process.
The next thing that the lawyer will know is the judges and prosecutors in the state. The lawyer should be able to tell you the kind of plea bargain that the prosecution will enter into, and whether or not the judge is the type of person who will look to give you the maximum allowed sentence. From this piece of information, you will be able to determine whether or not you should settle now or battle it out in court.
Your defense lawyer will dispatch investigators to the crime scene who will then compile a formal report on the incident. There may be a number of things that the police are hiding or missed.
Your lawyer will put witnesses on the stand that can help your case. You want the witnesses that speak in your defense to be reliable and credible.
The lawyer will also prepare your testimony. Make sure you work closely with the attorney to ensure that it is compelling and clear.
Motions will be prepared by your lawyer that the judge will have to rule on. It’s possible for these motions to either have the entire case thrown out or simply reduce the charges against you.
